WorldPulse Terms of Use
Version: 1.0
Effective date: Upon publication of this version.
These Terms of Use ("Terms") are an agreement between you and ALNILAM TECHNOLOGIES LLC, the company that provides and operates WorldPulse (referred to in these Terms as "WorldPulse," "we," "us," or "our"), governing the WorldPulse mobile application, related websites, content, and services (collectively, the "Service").
By creating an account, tapping an acceptance control, purchasing a subscription, or using the Service, you agree to these Terms and acknowledge the WorldPulse Privacy Policy and Community Guidelines. If you do not agree, do not create an account or use the Service.
The Apple Standard Licensed Application End User License Agreement also applies to the WorldPulse app. These Terms govern the WorldPulse account, community, User Content, subscriptions, and online services. If these Terms conflict with the Apple Standard EULA on a matter the Standard EULA controls, the Standard EULA controls.
1. Eligibility
You must be at least 13 years old to create or use a WorldPulse account. WorldPulse is not offered to anyone under 13. You may not use the Service if applicable law prohibits you from doing so.
If you are under the age of legal majority where you live, you represent that you have permission from your parent or legal guardian to use WorldPulse. Where law or an app marketplace requires parental approval, a parent or guardian must review and accept these Terms on your behalf and approve your access before you may use the Service. The parent or guardian agrees to supervise the minor's use and is responsible for that use to the extent permitted by law.
You must provide accurate age information and may not evade an age gate, parental control, safety restriction, or age-assurance process. Where Apple's age-assurance services indicate that an additional check applies, WorldPulse may request an Apple-provided age range or category after you tap Create Account. When no Apple check applies, WorldPulse uses the date of birth you provide and its server-side age rules.
WorldPulse may review underage-account reports, attempts to evade safeguards, and other relevant safety signals. If we reasonably believe that an account is under 13, is in the wrong age band, or used false age or guardian information, we may restrict the account while we investigate and may require reasonable proof of age before restoring or changing access. We may restrict or close an account when the concern is not resolved.
2. Accounts and Teen Accounts
You must provide accurate information, keep it current, protect your credentials, and promptly notify us if you suspect unauthorized access. You are responsible for activity through your account unless it results from WorldPulse's failure to use reasonable care.
You may not sell, transfer, share, or create an account for deceptive, abusive, or unlawful purposes. We may require reasonable verification to protect your account, other users, or the Service.
Accounts belonging to users ages 13 through 17 are Teen Accounts. Teen Accounts have private profiles and limited discoverability, may exchange messages only with accepted friends, and receive a limited default set of categories and features. The Assistant, blogs, clubs, current events, live features, and other eligible categories or capabilities may be unavailable unless a linked parent or guardian account unlocks them. The teen's profile remains private and messaging remains friends-only after an unlock. Restrictions may vary by age band, location, applicable law, and safety risk.
A linked parent or guardian account may manage the category and feature permissions identified in the Service and currently receives the teen's age band, link status, parent-granted categories, and parent-granted capabilities. Linking shows that an authenticated adult account accepted a temporary pairing code; it does not mean WorldPulse independently verified the adult's identity or legal relationship to the teen. WorldPulse will identify any future control that permits access to content or communications; parental linking does not silently provide access to direct-message contents. Teen users and parents or guardians may not bypass or help another person bypass these safeguards.
3. License to Use the Service
Subject to these Terms and Apple's Usage Rules, WorldPulse grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for lawful, noncommercial purposes. No ownership right in the app, Service, software, branding, or WorldPulse content is transferred to you.
Except where applicable law expressly permits it, you may not:
- copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Service;
- reverse engineer or attempt to obtain the Service's source code;
- scrape, crawl, automate access to, or extract data from the Service without written permission;
- bypass or attempt to bypass age gates, parental controls, content or safety controls, blocks, bans, moderation actions, subscription entitlements, authentication, rate limits, geographic restrictions, or other technical access controls;
- create or use replacement accounts, false age information, false guardian information, altered requests, automation, or other means to evade a restriction or enforcement action;
- probe, scan, test, exploit, or disclose a vulnerability without prior written authorization, or access accounts, systems, or data without permission;
- upload malware or interfere with the Service or another user's access; or
- use WorldPulse branding or content in a misleading or unauthorized way.
4. Your Content
You retain ownership of content you create or submit to WorldPulse ("User Content"). You represent that you have the rights and permissions needed to submit it and that it does not violate law, these Terms, the Community Guidelines, or another person's privacy, publicity, intellectual-property, or other rights.
To operate the Service, you grant WorldPulse a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, transcode, resize, adapt for technical formatting, transmit, display, and distribute your User Content within and through the Service according to the feature and audience settings you select. This license is limited to operating, securing, providing, and moderating the Service. WorldPulse will not use your User Content in off-platform advertising without separate permission.
The license ends when your User Content is deleted from active systems, except to the extent continued retention is reasonably necessary for protected backups, legal compliance, safety, enforcement, resolving disputes, or content another user has copied or reshared as permitted by the Service.
Public content may be viewed, recorded, copied, or reshared by other people. Do not submit information you are not comfortable sharing with the selected audience.
5. Community Conduct and Moderation
You must follow the WorldPulse Community Guidelines. Among other things, you may not:
- harass, threaten, stalk, bully, exploit, or impersonate another person;
- groom, sexually exploit, or endanger a minor; solicit sexual content, live location, private contact information, gifts, secrecy, or off-platform contact from a minor for an exploitative or inappropriate purpose; or misrepresent age to contact a minor;
- post hateful, sexually exploitative, violent, illegal, fraudulent, deceptive, or privacy-invasive content;
- share another person's private or sensitive information without authorization;
- infringe intellectual-property or other rights;
- distribute malware, spam, scams, or unauthorized advertising;
- manipulate engagement, misuse reporting tools, or evade enforcement; or
- use the Service in a way that endangers people or disrupts the Service.
You may report content and block users through available controls. WorldPulse may review, restrict, label, reduce distribution of, hide, preserve, restore, or remove content and may warn, restrict, suspend, or terminate accounts when reasonably necessary to enforce these Terms, protect safety, operate the Service, or comply with law. Authorized administrators may take these actions on reported or independently identified feed content, and WorldPulse may retain an audit history of moderation actions. We are not obligated to host any particular content.
WorldPulse does not guarantee that all objectionable content will be detected or removed immediately. If there is an urgent threat, contact local emergency services; reporting content in WorldPulse is not an emergency response.
Attempts to defeat WorldPulse safeguards may expose the user to account action and, depending on the conduct, civil or criminal liability. WorldPulse may investigate, preserve relevant evidence, seek available civil remedies, and refer suspected unlawful conduct to law enforcement or other authorities. Government authorities—not WorldPulse—decide whether to investigate, charge, or prosecute a person.
6. Direct Messages and Clubs
Treat direct messages and club spaces with the same care as public content. Direct messages are stored by WorldPulse, are not end-to-end encrypted, and may be accessed as described in the Privacy Policy. Do not assume that another user will keep information confidential.
Club creators and administrators are responsible for the information they publish and for managing memberships and meetings in compliance with law and these Terms. Adding a meeting to a device calendar does not guarantee that the meeting will occur or that its details are accurate.
7. Live Broadcasts, Recordings, Likes, and Comments
If you host a live broadcast, you are responsible for what you show, say, record, and transmit. You must obtain any permission required from people who appear or can be heard and from owners of locations, music, video, performances, or other protected material included in the broadcast.
WorldPulse live broadcasts are automatically recorded and are ordinarily retained for approximately 30 days. The host may replay an eligible completed recording in the app and may delete it before scheduled expiration. Related live-session records, comments, likes, and join activity are also ordinarily retained for approximately 30 days. WorldPulse may retain particular information longer when reasonably necessary for safety, legal compliance, enforcement, fraud prevention, or dispute resolution.
When you join, like, or comment on a live broadcast, your display name and activity may be visible to the host and other viewers. Viewer and like counts may be delayed or approximate.
Do not livestream emergencies, unlawful activity, graphic harm, copyrighted programming you lack permission to transmit, dangerous conduct, or private spaces without authorization. WorldPulse may delay, interrupt, terminate, decline to record, or remove a broadcast for safety, legal, operational, or moderation reasons.
8. WorldPulse Assistant and Wellness Features
The WorldPulse Assistant uses automated systems and third-party artificial intelligence to generate speech and present information. Output may be incomplete, delayed, unavailable, or inaccurate. Do not rely on the Assistant as the sole source for important decisions.
The Assistant may send text containing information described in the Privacy Policy to OpenAI for speech generation, but only after the separate permission described in the Privacy Policy is obtained. You may use the rest of the Service without enabling third-party Assistant speech, and you may withdraw permission in Settings.
Ergonomic check-ins, eye-break timers, wrist or posture exercises, and other wellness features are general wellness aids only. They are not medical advice, diagnosis, monitoring, or treatment and are not a substitute for a qualified health professional. Stop an exercise if it causes pain, dizziness, numbness, vision changes, or other concerning symptoms and seek appropriate care.
WorldPulse is not an emergency service. If you or another person may be in immediate danger, contact local emergency services.
9. News, Traffic, Jobs, and Other Informational Content
WorldPulse may display, organize, summarize, or link to news, weather, astronomy, traffic, health, mental-health, finance, jobs, elections, events, sports, entertainment, and other information. Traffic information is a city-level summary focused on major roads and is not turn-by-turn navigation, an emergency-routing service, or a complete report of every closure or hazard. This material is for general informational purposes and may be incomplete, delayed, or inaccurate. It is not medical, mental-health, legal, financial, investment, employment, election, emergency, or other professional advice.
Verify important information with an appropriate professional, official source, or original publisher. WorldPulse does not guarantee the availability, accuracy, completeness, or timeliness of third-party information.
Job listings may be supplied by administrators, employers, or third-party sources. WorldPulse is not the employer, recruiter, staffing agency, or guarantor of a listed opportunity unless a listing expressly says otherwise. Never pay to apply for a job or send money to a purported employer. Be alert for impersonation, phishing, requests for financial credentials, and offers that appear too good to be true. Confirm the role on the employer's official website before applying or sharing personal information. WorldPulse does not guarantee that a listing is authentic, current, complete, or suitable, and is not responsible for an employer's hiring decision or conduct.
10. Third-Party Services and Links
The Service may rely on or link to Apple, Amazon Web Services, HERE Technologies, OpenAI, Open-Meteo, mapping services, news publishers, scientific agencies, sports leagues, entertainment and event providers, telehealth services, employers, and other third parties. Third parties control their own content, availability, terms, fees, and privacy practices.
A link, listing, logo, thumbnail, or mention does not mean WorldPulse endorses or is affiliated with the third party. Your dealings with a third party are between you and that party. WorldPulse does not collect a job application merely because it links you to an employer or listing source.
11. WorldPulse Plus Subscriptions
WorldPulse Plus may be offered as an auto-renewable monthly or annual subscription through Apple's In-App Purchase system.
- Before purchase, the app displays the subscription title, duration, localized price, included features, and material renewal terms.
- Apple charges your Apple Account when you confirm the purchase.
- The subscription automatically renews for the same duration unless you cancel through Apple before renewal.
- Cancellation prevents future renewal; access ordinarily continues through the end of the paid period.
- Deleting the WorldPulse app or account does not cancel an Apple subscription. You must manage or cancel the subscription through Apple.
- Payments are non-refundable except where approved by Apple or required by law. Refund requests for App Store purchases must be submitted to Apple.
- Apple may refund, revoke, or otherwise adjust a transaction, and WorldPulse may adjust the corresponding entitlement.
- Subscription features may evolve. We will continue to provide the purchased offering for the paid period as required by law and our agreement with Apple.
Prices and availability may vary by storefront, tax, currency, and offer. The price Apple displays at confirmation controls. Any comparison, introductory, or promotional price shown in WorldPulse must be accurate, authorized, and accompanied by the applicable eligibility and duration terms.
12. Optional Platform-Support Purchases
WorldPulse may offer optional support purchases through Apple. Unless the purchase screen expressly states otherwise, a support purchase does not provide digital goods, charitable tax treatment, ownership, governance rights, or a WorldPulse Plus subscription. Apple processes the payment, and refunds are handled by Apple except where law requires otherwise.
13. Intellectual Property and Copyright Complaints
WorldPulse and its licensors own the Service, app, software, visual design, trademarks, and non-user content. Third-party content remains the property of its respective owner.
If you believe content on WorldPulse infringes your copyright, send a notice to Business@alnilamtechnologies.com that includes:
- your physical or electronic signature;
- identification of the copyrighted work claimed to be infringed;
- identification and location of the allegedly infringing material;
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or law; and
- a statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorized to act for the owner.
WorldPulse may remove or restrict content while reviewing a claim and may terminate repeat infringers in appropriate circumstances. We may forward a copyright notice or counter-notice to the affected user. Knowingly submitting a false claim may create liability.
14. Suspension, Account Deletion, and Termination
You may stop using the Service at any time. You may request immediate deletion or schedule deletion with a 30-day recovery period through in-app account settings. Scheduled deletion disables ordinary access; signing back in during the recovery period allows you to cancel the request. Permanent deletion is subject to the retention and legal exceptions in the Privacy Policy. Deleting an account does not cancel an Apple subscription.
We may restrict, suspend, or terminate access when we reasonably believe you violated these Terms, created legal or safety risk, endangered others, engaged in fraud or abuse, repeatedly infringed rights, or when necessary to protect or discontinue the Service. Where appropriate, we may provide notice and an opportunity to appeal. Serious or urgent violations may result in immediate action.
Sections that by their nature should survive termination—including ownership, licenses needed for retained copies, disclaimers, limitations, dispute terms, and indemnity—will survive.
15. Service Changes and Availability
We may add, change, suspend, or discontinue features. The Service may be unavailable because of maintenance, third-party outages, emergencies, network conditions, or circumstances outside our control. We do not promise uninterrupted, secure, or error-free operation.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." ALNILAM TECHNOLOGIES LLC, AS THE PROVIDER OF WORLDPULSE, DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT. THIS SECTION DOES NOT LIMIT RIGHTS OR WARRANTIES THAT CANNOT LEGALLY BE WAIVED.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALNILAM TECHNOLOGIES LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATING TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALNILAM TECHNOLOGIES LLC'S TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited. Nothing in these Terms waives consumer or privacy rights, or limits our obligations, that cannot be waived or limited under applicable law.
18. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless ALNILAM TECHNOLOGIES LLC, as the provider of WorldPulse, and its officers, members, employees, and contractors from third-party claims arising from your User Content, your unlawful use of the Service, or your material violation of these Terms. This section does not apply where prohibited by consumer law.
19. Governing Law, Mandatory Individual Arbitration, and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. EXCEPT FOR THE LIMITED EXCEPTIONS BELOW, IT REQUIRES YOU AND WORLDPULSE TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION, WAIVES THE RIGHT TO A JURY TRIAL, AND PROHIBITS CLASS, COLLECTIVE, CONSOLIDATED, AND REPRESENTATIVE ACTIONS. YOU MAY OPT OUT OF ARBITRATION AS EXPLAINED BELOW.
19.1 Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except to the extent federal law or non-waivable law where you live provides otherwise. The Federal Arbitration Act, 9 U.S.C. Sections 1–16, governs the interpretation and enforcement of this Section 19.
19.2 Informal dispute resolution
Before starting arbitration or filing an eligible court claim, the claimant must send the other party an individualized written Notice of Dispute and allow 30 days for a good-faith effort to resolve it. A notice to WorldPulse must be sent to Business@alnilamtechnologies.com and ALNILAM TECHNOLOGIES LLC, 12655 Whittington Dr., Houston, TX 77282-0112. WorldPulse may send a notice to the email address associated with your account.
The notice must include the claimant's name and contact information, the email address associated with the WorldPulse account, a description of the nature and factual basis of the dispute, and the specific relief requested. Any applicable limitations period and filing-fee deadline will be tolled during this 30-day period to the extent permitted by law. Either party may request an individual settlement conference. If the dispute is not resolved after 30 days, either party may start arbitration as provided below.
19.3 Binding individual arbitration
Except for the matters listed in Section 19.5, any dispute, claim, or controversy between you and WorldPulse arising out of or relating to the Service, these Terms, the Privacy Policy, any purchase, or the parties' relationship—including claims based in contract, tort, statute, fraud, misrepresentation, or any other legal theory—will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules and, when applicable, its Mass Arbitration Supplementary Rules, as modified by these Terms. The current rules are available at adr.org.
The arbitration will be decided by one neutral arbitrator. The arbitrator may award the same individual remedies that a court could award, including damages and individual injunctive or declaratory relief, but only to the extent necessary to resolve the individual claimant's claim. The arbitrator will issue a reasoned written decision. Judgment on the award may be entered in any court with jurisdiction.
Unless the parties agree otherwise, the arbitration may be conducted through written submissions, by telephone or videoconference, or in person in the county where you live or at another reasonably convenient location. If AAA is unavailable or declines to administer the arbitration and the parties cannot agree on a substitute administrator, a court with jurisdiction will select an administrator or arbitrator under 9 U.S.C. Section 5.
19.4 Arbitration fees
AAA's Consumer Arbitration Rules and fee schedule govern payment of filing, administration, hearing, and arbitrator fees. WorldPulse will pay all amounts it is required to pay under those rules or applicable law. Each party will ordinarily pay its own attorneys' fees and costs unless the arbitrator awards them under applicable law. WorldPulse will not seek its attorneys' fees or costs from you unless the arbitrator determines that your claim was filed for harassment or was frivolous under the standard applicable by law.
19.5 Exceptions and non-waivable rights
Either party may:
- bring an eligible individual claim in small-claims court;
- seek relief from a federal, state, or local government agency where the law permits the agency to act;
- ask a court for temporary or preliminary injunctive relief to preserve the status quo or prevent imminent harm while arbitration is pending; or
- bring a court action concerning infringement or misuse of intellectual-property rights or unauthorized access to the Service.
Nothing in this Section waives any right or remedy that cannot lawfully be waived. If applicable law permits a request for public injunctive relief to proceed only in court, that request will be decided by a court after the arbitrator resolves the arbitrable claims, unless applicable law requires a different order.
19.6 Jury-trial waiver and class-action waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WORLDPULSE WAIVE THE RIGHT TO A JURY TRIAL. EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE PROCEEDING.
Unless you and WorldPulse both agree in writing, the arbitrator may not combine more than one person's claims or preside over any class, collective, consolidated, coordinated, or representative proceeding. This restriction does not prevent the application of AAA's Mass Arbitration Supplementary Rules to individually filed arbitrations when AAA determines those rules apply.
19.7 How to opt out
You may opt out of the arbitration and class-action-waiver provisions in this Section 19 by sending an individual written notice within 30 days after you first accept the version of these Terms containing them. Send the notice to Business@alnilamtechnologies.com or ALNILAM TECHNOLOGIES LLC, 12655 Whittington Dr., Houston, TX 77282-0112. The notice must include your full name, the email address associated with your WorldPulse account, and an unambiguous statement that you want to opt out of the WorldPulse arbitration agreement. Opting out will not affect your account or access to the Service. An opt-out applies only to the individual who sends it, and a notice sent by one person cannot opt out anyone else.
If you timely opt out, neither you nor WorldPulse will be bound by Sections 19.3 through 19.6, and any dispute will be subject to Section 19.1 and the exclusive jurisdiction of the state and federal courts located in Harris County, Texas, except to the extent non-waivable law permits you to proceed elsewhere.
19.8 Changes to this arbitration agreement
If WorldPulse materially changes this arbitration agreement after you accept it, you may reject that change by sending written notice to Business@alnilamtechnologies.com within 30 days after the change becomes effective. Rejecting a later change does not reject the version you previously accepted. A change will not apply to a dispute for which either party sent a valid Notice of Dispute before the change was posted.
19.9 Severability
Except for the class- and representative-action waiver in Section 19.6, if any part of this Section 19 is found unenforceable, it will be severed or narrowed to the minimum extent necessary and the remainder will remain in effect. If a final decision determines that the waiver in Section 19.6 is unenforceable as to a particular claim or remedy, only that claim or remedy will proceed in court, and all other arbitrable claims will remain in arbitration. If a final decision determines that the waiver prevents an action that applicable law does not permit the parties to waive and cannot be severed, this Section 19 will not apply to that action.
If you are a minor and a parent or guardian accepts these Terms on your behalf, this Section applies to the parent or guardian and, to the extent enforceable under applicable law, to you. Nothing in this Section waives any right or remedy a minor cannot legally waive.
20. Apple-Specific Terms
You acknowledge that:
- these Terms are between you and ALNILAM TECHNOLOGIES LLC, as the provider of WorldPulse, not Apple;
- Apple is not responsible for operating or supporting the WorldPulse Service;
- Apple has no obligation to provide maintenance or support for WorldPulse;
- to the extent any warranty is required and cannot be disclaimed, you may notify Apple for a refund of the app purchase price, if any, and Apple has no other warranty obligation;
- ALNILAM TECHNOLOGIES LLC, not Apple, is responsible for claims concerning the Service, including product-liability, regulatory, consumer-protection, and intellectual-property claims, subject to these Terms and applicable law;
- you represent that you are not located in a country subject to a U.S. government embargo and are not listed on a U.S. government prohibited- or restricted-parties list; and
- Apple and its subsidiaries are third-party beneficiaries of the app-license terms and may enforce them.
Nothing in these Terms reduces any rights you have under the Apple Standard EULA or applicable law.
21. Changes to These Terms
We may update these Terms to reflect changes to the Service, law, or our practices. We will post the updated version and revise the effective date. For material changes, we will provide reasonable notice and request renewed acceptance when required. Changes do not apply retroactively unless permitted by law and clearly stated.
22. General Terms
If a provision of these Terms is unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, reorganization, or sale of assets. These Terms, the Privacy Policy, the Community Guidelines, and applicable purchase terms form the agreement between you and WorldPulse concerning the Service.
